Part 1—Preliminary 
1  Name
(1) This instrument is titled Migration (LIN 20/184: Subclass 462 (Work and Holiday) visa – Specified work and areas) Instrument 2020.
(2) This instrument may be cited as LIN 20/184.
2  Commencement
This instrument commences on the day after it is registered on the Federal Register of Legislation.
3  Authority
This instrument is made under regulation 1.15FA of the Regulations.
4  Definitions
Note: A number of expressions used in this instrument are defined in the Regulations, including ANZSCO and specified Subclass 462 work.
In this instrument:
COVID-19 means the pandemic declared by the World Health Organization on 11 March 2020, caused by the coronavirus COVID-19.
Regulations means the Migration Regulations 1994.
Subclass 462 visa means Subclass 462 (Work and Holiday) visa.
5  Repeal
This instrument repeals the Migration (LIN 20/104: Subclass 462 (Work and Holiday) Visa – Specified Areas of Australia and Kinds of Work) Instrument 2020 (LIN 20/104) (F2020L00223), in accordance with subsection 33(3) of the Acts Interpretation Act 1901.
6  Application
•            This instrument applies to an application for a Subclass 462 visa made on or after the commencement of this instrument.
•            Despite the repeal mentioned in section 5, LIN 20/104 continues to apply to an application for a Subclass 462 visa made and not finally determined immediately before the commencement of this instrument.

Part 2—Specified work and areas 
7  Fishing and pearling work and tree farming and felling work
(1) For regulation 1.15FA of the Regulations, each kind of fishing and pearling work and tree farming and felling work mentioned in the table in Schedule 1 is specified for the purposes of the definition of specified Subclass 462 work in regulation 1.03 of the Regulations.
(2) For regulation 1.15FA of the Regulations, for a State or Territory mentioned in an item in column 1 of table 1 in Schedule 4, each postcode area mentioned in column 2 for the item is specified for the purposes of the definition of specified Subclass 462 work in regulation 1.03 of the Regulations for any kind of work specified in subsection (1).
8  Tourism and hospitality work
(1) For regulation 1.15FA of the Regulations, each kind of tourism and hospitality work mentioned in the table in Schedule 2, is specified for the purposes of the definition of specified Subclass 462 work in regulation 1.03 of the Regulations.
(2) For regulation 1.15FA of the Regulations, for a State or Territory mentioned in an item in column 1 of table 1 in Schedule 4, each postcode area mentioned in column 2 for the item is specified for the purposes of the definition of specified Subclass 462 work in regulation 1.03 of the Regulations for any kind of work specified in subsection (1).
9  Plant and animal cultivation work and construction work
(1) For regulation 1.15FA of the Regulations, each kind of plant and animal cultivation work and construction work mentioned in the table in Schedule 3 is specified for the purposes of the definition of specified Subclass 462 work in regulation 1.03 of the Regulations.
(2) For regulation 1.15FA of the Regulations, for a State or Territory mentioned in an item in column 1 in either table 1 or table 2 in Schedule 4, each postcode area mentioned in column 2 of that table for the item is specified for the purposes of the definition of specified Subclass 462 work in regulation 1.03 of the Regulations for any kind of work specified in subsection (1).
10  Bushfire recovery work 
•            For regulation 1.15FA of the Regulations, bushfire recovery work, including volunteer work, carried out after 31 July 2019, including but not limited to work mentioned in paragraph (a) or (b), is specified for the purposes of the definition of specified Subclass 462 work in regulation 1.03 of the Regulations:

•                 construction, farming, or any other work in association with recovery or restitution of land, property, farm animals or wildlife;
•                 providing support services or assistance to people living, working or volunteering in the affected areas.

•            For regulation 1.15FA of the Regulations, for a State or Territory mentioned in an item in column 1 of table 3 in Schedule 4, the local government area mentioned in column 2 for the item is specified for the purposes of the definition of specified Subclass 462 work in regulation 1.03 of the Regulations for any kind of work specified in subsection (1).

11  Critical COVID-19 work in the healthcare and medical sectors
•            For regulation 1.15FA of the Regulations, critical COVID-19 work in the healthcare and medical sectors carried after 31 January 2020, including but not limited to work mentioned in paragraph (a) or (b), is specified for the purposes of the definition of specified Subclass 462 work in regulation 1.03 of the Regulations:

•            medical treatment, nursing, contact tracing, testing and research;
•           support services such as cleaning of medical and health care facilities and equipment.

•            For regulation 1.15FA of the Regulations, each area within any Australian postcode area is specified for the purposes of the definition of specified Subclass 462 work in regulation 1.03 of the Regulations for the kinds of work specified in subsection (1).
