Schedule 3—Amendments of LIN 19/219 Migration (LIN 19/219: Occupations for Subclass 494 Visas) Instrument 2019 1  Paragraph 5(1)(c) Repeal the paragraph, substitute:  (c) subject to subsections 6(2) and 7(2), the occupation applies to a nominee if the tasks of the occupation that are to be performed by the nominee correspond to the tasks set out in that ANZSCO code. 2  Section 6 Before “The following table”, insert “(1)”. 3  At the end of section 6 Add:  (2) For the purposes of subregulation 2.72C(11) of the Regulations:  (a) for item 13 of the table in subsection (1), the occupation does not apply to the nominee if the position in which the nominee is to work is an exotic dancer. 4  Section 7 Before “The following table”, insert “(1)”. 5  At the end of section 7 Add:  (2) For the purposes of subregulation 2.72C(11) of the Regulations:  (a) for item 79 of the table in subsection (1), the occupation does not apply to the nominee if the position in which the nominee is to work is a brothel keeper. Schedule 4—Amendments of IMMI 18/039 Migration (IMMI 18/039: Mandatory Skills Assessment—Subclass 482 Visa) Instrument 2018 1  Section 3 After “under”, insert “subregulation 2.26B(1) and”. 2  Section 4 Insert: VETASSESS means Vocational Education and Training Assessment Services. 3  Subsection 5(2) Omit “subparagraphs 1240(3)(g)(ii), (iv) and (v) of Schedule 1 to”, insert “subregulation 2.26B(1) of, and subparagraphs 1240(3)(g)(ii), (iii) and (iv) of Schedule 1 to,”. 4  After paragraph 5(2)(a) Insert  (aa) the class of persons is specified to be the persons mentioned in subsection (1); and 5  Paragraph 5(2)(b) Repeal the paragraph, substitute:  (b) a person or body mentioned in column 3 of the item is specified as the relevant assessing authority for:  (i) the skilled occupation; and  (ii) all countries; and   for the purposes of an application for a skills assessment made by a resident of one of those countries; and 6  Subsection 5(2) (table) Omit “Assessing authority”, substitute “Relevant assessing authority”. Schedule 5—Amendments of LIN 19/260 Migration (LIN 19/260: Assessing Authorities for Subclass 494 Visas) Instrument 2019 1  Section 3 Omit “subclause 494.224(6) of Schedule 2 to”, substitute “subregulation 2.26B(1) of”. 2  Section 5 Repeal the section, substitute: 5  Relevant assessing authorities   For the purposes of subregulation 2.26B(1) of the Regulations, a person or body mentioned in column 2 of an item of the Medium and Long term Strategic Skills List or the Regional Occupation List is specified as the relevant assessing authority for:  (a) the occupation; and  (b) all countries; for the purposes of an application for a skills assessment made by a resident of one of those countries. Schedule 6—Amendments of LIN 19/050 Migration (LIN 19/050: Specification of Occupations—Subclass 407 Visa) Instrument 2019 1  Paragraph 6(c) Repeal the paragraph, substitute:  (c) subsection to subject 7(2), the occupation applies to the holder of, or an applicant or proposed applicant for, (the nominee) a Subclass 407 (Training) visa if the tasks of the occupation that are to be performed by the nominee correspond to the tasks set out in the ANZSCO code specified for the occupation. 2  Section 7 Before “The occupations”, insert “(1)”. 3  At the end of section 7 Add:  (2) For the purposes of paragraph 2.72B(3)(b) of the Regulations:  (a) for item 13 of the table in subsection (1), the occupation does not apply to the nominee if the position in which the nominee is to work is an exotic dancer.
