1  Name
  This instrument is the Migration (Daily Maintenance Amount for Persons in Detention) Determination 2026.
2  Commencement
  This instrument commences on 1 July 2026.
3  Authority
  This instrument is made under subsection 262(2) of the Migration Act 1958.
4  Definitions
Note: A number of expressions used in this instrument are defined in the Act, including the following:
•      detention centre;
•      immigration detention.

  In this instrument:
Act means the Migration Act 1958.
5  Schedules
Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
6  Daily maintenance amount etc
 (1) For the purposes of subsection 262(2) of the Act:
 (a) the daily amount is determined to be $702.31; and
 (b) the period between 1 July 2026 and 30 June 2028 is specified.
 (2) For the purposes of subsection 262(2) of the Act, the following places are specified:
 (a) each place approved by the Minister in writing under subparagraph (b)(v) of the definition of immigration detention in subsection 5(1) of the Act;
 (b) each place that is a detention centre established and maintained under subsection 273(1) of the Act mentioned in an item in the following table.
