ARRANGEMENTS FOR WORK AND HOLIDAY AND WORKING HOLIDAYS VISA APPLICATIONS 2016

(Items 1224A and 1225 and paragraph 462.221(c))

I, JUDITH O’NEILL, Delegate of the Minister for Immigration and Border Protection, acting under subregulation 2.07(5) of the Migration Regulations 1994 (the Regulations) for items 1224A and 1225 of Schedule 1 and paragraph 462.221(c) of Schedule 2 to the Regulations:

REVOKE Instrument Number IMMI 15/116 signed on 9 September 2015 (F2015L01437);
SPECIFY for the purposes of paragraph 1224A(3)(a) of Schedule 1 to the Regulations, the foreign countries in Column 1 of the table in Schedule 1 to this Instrument;
SPECIFY in the below table, for the purposes of a Work and Holiday (Temporary)(Class US) – Subclass 462 (Work and Holiday) visa:

a) In Column A, for subregulation 2.07(6) of the Regulations, the classes of applicant;

b) In Column B, for subitem 1224A(1) of Schedule 1 to the Regulations, the approved forms; and

c) In Column C, for paragraph 1224A(3)(aa) of Schedule 1 to the Regulations, the place and manner for lodging an application:

Applicants who hold a valid passport issued by the United States of America	1208 or 1208E (Internet)	Applications, that are not Internet applications, may be made in any foreign country at a diplomatic, consular or migration office maintained by or on behalf of the Commonwealth outside Australia.
Applicants who hold a valid passport issued by the People’s Republic of China	1208	Application must be made by appointment and in person at an address specified in column 4 of the table in Schedule 1 to this instrument for the corresponding country.
Applicants who hold a valid passport issued by a foreign country specified in Column 1 of the table in Schedule 1 to this Instrument	1208	Applications must be made at the addresses, specified in Column 3 or Column 4 of the table in Schedule 1 to this Instrument for the corresponding foreign country.

4. SPECIFY for the purposes of paragraph 1224A(3)(aa) of Schedule 1 to the Regulations, the postal addresses and street addresses for lodging an application in Column 3 and Column 4, respectively, in the table in Schedule 1 to this Instrument, for applicants who hold a valid passport issued by the corresponding foreign countries set out in Column 1 of the table in Schedule 1 to this Instrument;

5. SPECIFY for the purposes of subparagraph 1224A(3)(b)(iii) of Schedule 1 to the Regulations, that persons who hold a valid passport issued by China, or the United States of America are a class of persons who are not required to provide evidence of government support for grant of the visa;

6. SPECIFY for the purposes of subparagraph 1224A(3)(c)(iii) of Schedule 1 to the Regulations, that a class of persons consists of holders of passports issued by the Islamic Republic of Iran;

7. SPECIFY for the purposes of paragraph 462.221(c) of Schedule 2 to the Regulations. The educational qualifications, in Column 2 of the table in Schedule 1 to this Instrument, and the corresponding specified foreign country, in Column 1 of the table in Schedule 1 to this Instrument;

8. SPECIFY in the below table for the purposes of Working Holiday (Temporary)(Class TZ) – Subclass 417 (Working Holiday) visa:

a) In Column A, for subregulation 2.07(6) of the Regulations, the classes of applicant;

b) In Column B, for subitem 1225(1) of Schedule 1 to the Regulations, the approved forms; and

c) In Column C, the following place and manner for making an application for sub item 1225(3) of Schedule 1 to the Regulations:
