Part 1—Preliminary

1 Name

This instrument is the Migration (Approval of Primary and Fall-back Reporting Systems—International Passenger Aircraft) Instrument 2025.

2 Commencement

This instrument commences on the day after it is registered.

3 Authority

This instrument is made under the following provisions of the Migration Act 1958:

(a) section 245J;

(b) section 245K

4 Definitions

In this instrument:

ABOC means the Australian Border Operations Centre.

Act means the Migration Act 1958.

Department means the Department of Home Affairs, including the Australian Border Force.

international passenger aircraft has the meaning given by regulation 3.13 of the Regulations.

Regulations means the Migration Regulations 1994.

5 Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Part 2—Primary and fall-back reporting systems for crew

6 Approval of primary reporting system—crew

For the purposes of section 245J of the Act, the following system is the approved primary reporting system for each member of the crew of an international passenger aircraft:

(a) the interactive Advance Passenger Information system called the Advance Passenger Processing System, as provided by C P S Systems Pty Ltd (ABN 64 000 965 551, ACN 000 965 551), part of the Société Internationale de Télécommunications Aéronautiques NaamlozeVennootschap.

7 Information to be reported under primary reporting system—crew

(1) For the purposes of subsection 245J(3) of the Act, the information set out in the following table is specified to be reported about each member of the crew of an international passenger aircraft who holds:

(a) an Australian passport;

(b) a New Zealand passport; or

(c) a travel document, other than an Australian or New Zealand passport, with a Crew Travel Authority as provided by the Department.

1	Crew Type	The type of crew person, either: (C) Operating Crew; or (X) Positioning Crew.
2	Document Type	The type of travel document, either: (P) Passport; (O) Other; or (N) None.
3	Document Number	The assigned number of an official identification document issued by a state or organisation to a person for the purposes of international travel. Blank only if Document Type is (N).
4	Traveller’s Nationality Code	As documented in the travel document, the three-letter country code assigned by the International Civil Aviation Organisation.
5	Family Name	The first four characters of the person’s family name.
6	Trans-Border Flight	The flight number used by the operator of the air service on which the person will cross the Australian border.
7	Check-In Port	The port at which the person commences an international movement and at which advance passenger information for the person is collected.
8(a)	Expected Port	The Australian port at which the person will be cleared by the Department for movement into Australia.
8(b)	Expected Port	The Australian port at which the person will be cleared by the Department for departure from Australia.
9	Check-in Date	The check-in date and time (according to Greenwich Mean Time) used to locate the person.
10(a)	Trans-Border Port	The first port in Australia at which the person will arrive when travelling to Australia.
10(b)	Trans-Border Port	The last port in Australia at which the person will depart when travelling from Australia.
11	Transit Indicator	An indicator that the person is transiting at origin or destination (if applicable).

(2) For the purposes of subsection 245J(3) of the Act, the information set out in the following table is specified to be reported about each member of the crew of an international passenger aircraft who has obtained up-lift approval from the ABOC.

9	Trans-Border Flight	The flight number used by the operator of the air service on which the person will cross the Australian border.
10	Check-In Port	The port at which the person commences an international movement and at which advance passenger information for the person is collected.
11(a)	Expected Port	The Australian port at which the person will be cleared by the Department for movement into Australia.
11(b)	Expected Port	The Australian port at which the person will be cleared by the Department for departure from Australia.
12	Check-in Date	The check-in date and time (according to Greenwich Mean Time) used to locate the person.
13(a)	Trans-Border Port	The first port in Australia at which the person will arrive when travelling to Australia.
13(b)	Trans-Border Port	The last port in Australia at which the person will depart when travelling from Australia.
14	Transit Indicator	An indicator that the person is transiting at origin or destination (if applicable).

8 Approval of fall-back reporting systems—crew

For the purposes of section 245K of the Act, the following systems are approved as fall-back reporting systems for each member of the crew of an international passenger aircraft:

(a) the ABOC, by telephone to either of the following telephone numbers in Australia:

(i) 1300 368 126; or

(ii) (02) 6264 1301; or

(b) the ABOC, by email: ABOC@abf.gov.au; or

(d) APPchat.

9 Information to be reported under fall-back reporting systems—crew

(1) For the purposes of subsection 245K(2), the information in the following table is specified to be reported about each member of the crew of an international passenger aircraft for flights arriving in Australia.

Item	Information
1	The flight number, port of arrival of the aircraft and the expected date of arrival of the aircraft.
2	Where the operator has confirmed that each crew member has boarded the aircraft, each person holds: (a) a travel document, other than an Australian or New Zealand passport, and a visa or Crew Travel Authority, which is in effect that permits the person to travel to and enter Australia; or (b) a current Australian or New Zealand passport.
3	For each crew member who the operator has not confirmed as falling within Item 2, whether the operator has obtained up-lift approval from the ABOC.

(2) For the purposes of subsection 245K(2), the information in the following table is specified to be reported about each member of the crew of an international passenger aircraft for flights departing from Australia.

1	The flight number, port of departure of the aircraft and the expected date of departure of the aircraft.

10 Approval of primary reporting system—passengers

For the purposes of section 245J of the Act, the following system is the approved primary reporting system for each passenger of an international passenger aircraft:

11 Information to be reported under primary reporting system—passengers

(1) For the purposes of subsection 245J(3) of the Act, the information set out in the following table is specified to be reported about each passenger of an international passenger aircraft who holds:

(a) an Australian passport;

(b) a New Zealand passport; or

(c) a travel document, other than an Australian or New Zealand passport, and a visa which is in effect, other than a special purpose visa, that permits the person to travel to and enter Australia.

(b) has obtained up-lift approval from the ABOC.

12 Approval of fall-back reporting systems—passengers

(1) For the purposes of section 245K of the Act, the following systems are approved as fall-back reporting systems for each passenger of an international passenger aircraft:

(a) the ABOC, by telephone to either of the following telephone numbers in Australia:

(i) 1300 368 126; or

(ii) (02) 6264 1301; or

(b) the ABOC, by email: ABOC@abf.gov.au; or

(d) APPchat.

13 Information to be reported under fall-back reporting systems—passengers

(1) For the purposes of subsection 245K(2), the information in the following table is specified to be reported about each passenger of an international passenger aircraft for flights arriving in Australia.
